Confirm Your Booking

1. Booking & Payment
1.1 The buyer can book a machine/product for a period of 7 days by paying an advance of 5% of the asset value.
1.2 The booking amount must be paid through the designated payment methods available on the TPH platform.
1.3 Booking a machine/product does not guarantee purchase; it only ensures priority access and the opportunity to complete due diligence as the machine will be blocked for other TPH users.
2. Buyer Responsibilities Post-Booking Upon successful payment, the buyer must complete the following within the 7-day booking period:
2.1 Schedule an Inspection: Contact the TPH team to arrange an appointment for a physical inspection of the machine/product.
2.2 Negotiate & Finalize Terms: Work with TPH and the seller to finalize the asset’s value and establish terms for removal/lifting from the seller’s premises.
2.3 Arrange Payment: If the machine/product is deemed satisfactory, the buyer must arrange for the remaining payment (final agreed deal value minus the advance paid).
3. Refund Policy
The booking amount (less applicable deductions) will be refunded in the following cases:
3.1 Seller Rejects the Offer: If the seller does not agree to proceed with the sale.
3.2 Machine/Product Not Suitable: If the machine/product is found unsuitable upon inspection.
3.3 Failure to Complete Inspection/Negotiation: If the buyer is unable to schedule an inspection, negotiate, or coordinate within the 7-day booking period.
3.4 Buyer Opts Out: If the buyer decides not to pursue the purchase for any reason.
4. Deductions & Fees
4.1 In case of a refund, a platform fee of 2% of the booking amount + GST will be deducted as a service charge.
4.2 The remaining amount will be refunded through the original payment method within 7-10 business days.
5. Additional Terms
5.1 If the buyer fails to take any action within the 7-day booking period, the booking will expire, and the amount paid will be non-refundable.
5.2 The buyer acknowledges that TPH serves as an intermediary platform and is not liable for the machine’s condition, seller’s decisions, or the outcome of negotiations.
5.3 Any disputes arising from this agreement shall be resolved as per the dispute resolution mechanism outlined in TPH's general Terms of Service.

Deal Terms

TPH Buyers Deal Management Fees

1% + GST of the deal value is charged to the buyer upon deal completion for co-ordinating the deal end-to-end for you.

Inspection

Assets can be inspected by appointment only. Contact Team TPH to schedule your visit.

Booking & Offers

Found the right machine? Secure it for 7 days with a nominal booking fee, giving you time for inspection, price negotiation, and finalizing terms. If multiple offers are received during this period, the seller reserves the right to choose the most suitable one.

Rigging & Logistics

Once the deal is finalized, Team TPH can help you with optional services for packing, decommissioning, loading, lifting, transportation, and in-transit insurance. Enjoy multiple VAS options and with just 1% + GST as an additional TPH Service Fees over and above the VAS charges, making your transactions stress-free.

Payment Terms & Conditions

These Payment Terms & Conditions (“Payment Terms”) govern all payments made by Buyers through The Purchase House website for the purchase of industrial machinery, equipment, spare parts, inventory, and other listed industrial assets. By making any payment through the Platform, the Buyer acknowledges that they have read, understood, and agreed to these Payment Terms.

Payment Authorization
By completing the payment, the Buyer authorizes The Purchase House to collect the applicable payment amount for the selected product(s) through the payment methods available on the Platform.

The Buyer confirms that the payment method used belongs to them or that they are legally authorized to use it.
Pricing
All prices displayed on the Platform are in Indian Rupees (INR) unless otherwise specified.

Prices displayed on the Platform may be inclusive or exclusive of applicable taxes, as indicated on the respective product page.

Prices are subject to change without prior notice until the payment has been successfully received and the order has been confirmed by The Purchase House.
Payment Methods
The Purchase House accepts payments through secure payment channels, including but not limited to:
- Any payment method made available on the Platform
Payment Confirmation
A purchase shall be considered confirmed only after:
- Successful receipt of the payment by The Purchase House;
- Verification of the transaction, where required; and
- Confirmation of the order by The Purchase House.
Receipt of payment alone does not automatically guarantee acceptance or confirmation of the order.
Order Verification
The Purchase House reserves the right to verify the Buyer’s payment details, billing information, or order details before processing any transaction.

Where necessary, The Purchase House may request additional information or documentation to complete the verification process. The Purchase House also reserves the right to place any transaction on hold or cancel an order if fraudulent, unauthorized, or suspicious activity is suspected.
Taxes & Additional Charges
Applicable GST and other statutory taxes shall be charged in accordance with applicable laws.

Where applicable, additional charges such as transportation, loading/unloading, insurance, documentation, bank charges, or payment gateway charges shall be payable by the Buyer and will be communicated during the order process.
Payment Failure
If a payment transaction fails due to banking issues, payment gateway errors, insufficient funds, technical issues, network failures, or any other reason, the order shall not be processed until successful payment is received.

The Purchase House shall not be held responsible for delays or failures caused by banks, payment gateways, or other third-party payment service providers.
Fraud Prevention
The Purchase House reserves the right to refuse, suspend, investigate, or cancel any transaction suspected to be fraudulent, unauthorized, illegal, or in violation of applicable laws.

Additional verification documents may be requested before approving such transactions.
Refunds
Refunds, where approved by The Purchase House, shall be processed in accordance with the applicable Refund & Cancellation Policy.

Approved refunds shall be credited through the original mode of payment after applicable deductions, if any.

Refunds shall not be processed in cash.

The applicable refund processing timeline may vary depending upon the payment service provider or banking institution.
Order Cancellation
Cancellation requests shall be subject to The Purchase House applicable Cancellation Policy.

Once an order has been confirmed and processing has commenced, cancellation may not be permitted or may be subject to applicable cancellation charges, unless otherwise approved by THE PURCHASE HOUSE.
Ownership of Goods
Ownership of the purchased Asset shall transfer to the Buyer only after:
- Successful receipt of the full payment by The Purchase House;
- Completion of all required documentation, where applicable; and
- Fulfilment of all payment obligations.
Payment Security
The Purchase House uses secure payment gateways and commercially reasonable security measures to process online payments.

However, The Purchase House shall not be liable for any interruption, technical error, unauthorized banking transaction, cyber incident, or payment gateway failure beyond its reasonable control.
Limitation of Liability
The Purchase House acts as a marketplace facilitating industrial transactions between Buyers and Sellers.

The Purchase House liability relating to payments shall be limited to the amount actually received by The Purchase House for the respective order.

Under no circumstances shall The Purchase House be liable for any indirect, incidental, consequential, or special damages arising from payment delays, banking issues, third-party payment gateway failures, or events beyond its reasonable control.
Changes to Payment Terms
The Purchase House reserves the right to amend, modify, or update these Payment Terms & Conditions at any time without prior notice.

Any revised Payment Terms shall become effective immediately upon their publication on the Platform.
Governing Law
These Payment Terms & Conditions shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Payment Terms shall be subject to the exclusive jurisdiction of the competent courts at Nashik, Maharashtra.
Shipping & Delivery
Shipping, transportation, loading, unloading, lifting, and related logistics shall be the responsibility of the Buyer or Seller, as mutually agreed between them.

Upon request, The Purchase House may assist in arranging transportation through third-party service providers for the convenience of the Buyer or Seller. However, The Purchase House acts only as a facilitator and shall not be responsible or liable for any delay, damage, loss, or other issues arising during shipping, transportation, loading, unloading, lifting, or delivery of the purchased Asset.
